Rafflebags – Prize Draw Terms and Conditions

These Terms and Conditions (“Terms”) govern entry into prize draws (“Competition” or “Draw”) promoted on rafflebags.com (the “Site”) by Rafflebags Limited. By entering a Competition you accept these Terms in full. If you do not accept these Terms, do not enter.

- Definitions

- Status as a free prize draw
Each Competition is operated as a free prize draw under section 339 and Schedule 2 of the Gambling Act 2005. We always offer a genuine, free postal entry route (set out in clause 6) which is no less prominent and no less convenient than the paid entry route. No purchase is necessary to enter or to win. Free postal Entries are received, processed and have an equal chance of winning to paid Entries.
- Voluntary Code
We support the Voluntary Code of Good Practice for Prize Draw Operators and operate in line with its principles on player protection, transparency and accountability.
- Eligibility
5.1 To enter a Competition you must:
(a) be aged 18 or over;
(b) be a resident of Great Britain (England, Scotland or Wales). Residents of Northern Ireland, the Channel Islands, the Isle of Man and any other territory are not eligible;
(c) not be an employee, contractor, officer, immediate family member or member of the household of Rafflebags Limited or of any party professionally connected with the running of the Competition.
5.2 We may require evidence of age or residency before issuing a Prize. Failure to provide reasonable evidence within 14 days of request may result in the Entry being void and an alternative winner being drawn.
5.3 By entering you confirm that all information you provide is true, accurate and complete and that you are entering on your own behalf.
- How to enter
6.1 Paid online entry
Entries may be purchased through the Site at the price stated on the Competition page. Each Entry is allocated a unique entry number on receipt of cleared payment. An entry confirmation email will be sent to the email address you provide.
6.2 Free postal entry
To enter without payment, send a postcard or unsealed envelope by first-class post to:

Your entry must include, clearly and legibly:
(a) full name;
(b) full postal address;
(c) date of birth;
(d) email address;
(e) telephone number;
(f) the title of the Competition you wish to enter.
6.3 Postal entry rules
(a) Each free postal Entry must be sent in a separate envelope or as a separate postcard. Bulk submissions will be treated as a single Entry.
(b) Entries must be received by us at the address above before the Closing Date stated on the relevant Competition page. We are not responsible for postal delays, lost mail or items damaged in the post.
(c) The maximum number of free postal Entries you may submit is 1 entry per person, per competition, per postage stamp.
(d) The only cost of a free postal Entry is your own postage. We receive no commercial benefit from postal Entries.
(e) Free postal Entries are issued an entry number on receipt and are entered into the same Draw on equal terms with paid Entries.
6.4 Equivalence
Free postal Entries are accepted on equal terms to paid online Entries. There is no advantage to paying.
- Entry validity
7.1 We may refuse or void any Entry that we reasonably consider to be:
(a) incomplete, illegible or fraudulent;
(b) submitted in breach of these Terms;
(c) in breach of applicable law; or
(d) submitted using automated means, scripts, bots or any tool designed to circumvent normal entry.
7.2 No correspondence will be entered into in respect of voided Entries, save where required by law.
- Closing Date
The Closing Date for each Competition will be stated on the Competition page. We reserve the right to extend the Closing Date in accordance with clause 17.
- The Draw
9.1 Each Competition is drawn after the Closing Date by an independent third-party draw verifier using a verifiable random number generator. Where the verifier issues a draw certificate or video, this will be made available on request and is conclusive evidence of the result.
9.2 The winner will be notified by email and/or telephone using the contact details provided with their Entry, normally within 7 days of the Draw.
9.3 If the winner does not respond to confirm acceptance of the Prize and provide delivery details within 14 days of first contact, we may, acting reasonably, void the original Entry and conduct a redraw on the same basis.
- The Prize
10.1 The Prize for each Competition is described on the relevant Competition page, together with its recommended retail price (“RRP”).
10.2 All handbags advertised as a Prize are sourced new from authorised retailers or boutiques and are supplied with their original packaging, dust bag and authentication documentation as supplied by that retailer.
10.3 No cash alternative is offered other than as set out in clauses 11 and 12.
10.4 The Prize is non-transferable.
- Cash alternative if Prize is unavailable
If, after the Closing Date, the specific Prize stated on the Competition page becomes genuinely unavailable for reasons outside our reasonable control (for example, the model is discontinued or out of stock with all of our supplying retailers), we will offer the winner a cash alternative equal to seventy-five percent (75%) of the stated RRP, paid by bank transfer to a UK bank account in the winner’s name within 30 days of the winner accepting the alternative.
- Minimum entries
12.1 Each Competition has a minimum number of Entries required for the advertised Prize to be awarded. The minimum will be stated on the Competition page.
12.2 If the minimum number of Entries is not received by the Closing Date we may, in our discretion, do one of the following:
(a) extend the Closing Date by up to 30 days, with notice on the Competition page and to all Entrants by email;
(b) draw the Competition on the original Closing Date and award the winner a cash alternative equal to seventy-five percent (75%) of the value of total paid Entries received, paid by bank transfer to a UK bank account in the winner’s name; or
(c) cancel the Competition and refund all paid Entrants in full.
12.3 We will publish the action taken under clause 12.2 on the Site within 5 working days of the original Closing Date.
- Delivery
13.1 The Prize will be dispatched to the winner’s UK address by an insured, tracked courier service within 15 working days of the winner confirming acceptance and providing complete delivery details.
13.2 Risk in the Prize passes to the winner on delivery.
13.3 We do not deliver outside the United Kingdom or to Northern Ireland.
- Publicity
14.1 Following each Draw we will publish the winner’s first name, last initial and county on the Site and on our social media channels, and we may invite the winner to participate in further publicity. Participation in further publicity is voluntary.
14.2 If the winner objects to the publication of any information under clause 14.1 they must notify us in writing within 7 days of being notified that they have won.
- Responsible play
15.1 We support responsible participation in prize draws. Free-to-play options are available via clause 6.
15.2 Spend and frequency. We encourage all Entrants to set personal limits on the time and money they spend entering Competitions, and never to spend more than they can comfortably afford to lose.
15.3 Cooling-off. You may request a 24-hour, 7-day or 30-day pause on your account by emailing hello@rafflebags.com. During a pause we will not accept paid Entries from you and will not send marketing communications to you.
15.4 Self-exclusion. You may request self-exclusion from all our Competitions for a minimum period of 6 months by emailing hello@rafflebags.com. Once self-exclusion is in place we will close your account, refuse paid Entries from you and remove you from marketing lists for the period requested. Self-exclusion can be extended on request and cannot be lifted before the agreed end date.

- Account suspension or cancellation
We may suspend or cancel your account, void Entries and refuse future Entries if we reasonably believe you have:
(a) breached these Terms;
(b) engaged in fraudulent or abusive conduct;
(c) provided false information; or
(d) attempted to circumvent eligibility, age or entry rules.
- Cancellation, suspension or amendment of a Competition
17.1 We may cancel, suspend, modify or amend a Competition where we reasonably consider it necessary to do so, including:
(a) where required by law or by regulator action;
(b) where the integrity of the Competition cannot be reasonably guaranteed; or
(c) for circumstances of force majeure.
17.2 Where a Competition is cancelled before the Closing Date, all paid Entrants will be refunded in full.
- Refunds
Paid Entries are non-refundable once submitted, except where:
(a) we cancel the Competition under clause 17.2;
(b) we refund Entrants under clause 12.2(c); or
(c) we are required to provide a refund under applicable law.
- Liability
19.1 Nothing in these Terms limits or excludes our liability for:
(a) death or personal injury caused by our negligence;
(b) fraud or fraudulent misrepresentation; or
(c) any other liability that cannot be limited or excluded under English law.
19.2 Subject to clause 19.1, our total aggregate liability to you in connection with any Competition or these Terms is limited to:
(a) the value of the entry fees paid by you to that Competition; or
(b) where the claim concerns a Prize awarded to you, the RRP of that Prize.
19.3 Subject to clause 19.1, we are not liable for any indirect or consequential loss, loss of profit, loss of opportunity, loss of data or loss of goodwill arising in connection with these Terms.
19.4 Once a Prize has been delivered, any defects, manufacturing issues or warranty claims should be raised directly with the brand or retailer. We will provide reasonable assistance to the winner in connection with such claims but we are not the manufacturer or warrantor of the Prize.
- Force majeure
We are not liable for any failure or delay in performing our obligations caused by events outside our reasonable control, including acts of God, war, terrorism, civil unrest, pandemic, fire, flood, industrial action, internet or power failure, or actions of government or regulator.
- Privacy and data
We process Entrants’ personal data in accordance with our Privacy Policy at [PRIVACY POLICY URL] and in compliance with the UK GDPR and the Data Protection Act 2018.
- Intellectual property
The Site and its content (including text, images, logos, code and design) are owned by or licensed to Rafflebags. You may not reproduce, distribute, republish or use the content of the Site other than for your personal, non-commercial use in connection with a Competition.
- Complaints and dispute resolution
23.1 If you have a complaint, please email hello@rafflebags.com or write to us at our operational address. We aim to acknowledge complaints within 2 working days and to resolve all complaints within 30 days.
23.2 Advertising-related complaints concerning a Competition may be referred to the Advertising Standards Authority at [asa.org.uk](https://www.asa.org.uk).
23.3 Data protection complaints may be referred to the Information Commissioner’s Office at [ico.org.uk](https://ico.org.uk).
- General
24.1 If any clause of these Terms is found to be unenforceable, the remaining clauses shall remain in full force and effect.
24.2 No failure or delay by us in exercising any right under these Terms shall constitute a waiver of that right.
24.3 These Terms are between you and us. No other person has any right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.
24.4 We may update these Terms from time to time. The version in force at the time of your Entry applies to that Entry. The current version is always available on the Site.
24.5 Nothing in these Terms affects your statutory rights as a consumer.
- Governing law and jurisdiction
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, save that consumers resident in Scotland may bring proceedings in the Scottish courts.
